Our client, a major player in Nigeria’s shipbuilding and maintenance, was sued as a defendant in an admiralty action in rem arising from its application to arrest and remove a vessel under a lawful court order from its shipyard.
The Plaintiff, Nigerian Pipeline & Storage Company Limited, claims that the vessel’s arrest and removal caused damage to its jetty facility, and seeks to hold our client liable on grounds of negligence. Our client’s position is clear, as they obtained the removal of the Vessel by due process, by an arrest order of the Vessel issued by a Judge of the Federal High Court.
OAL is vigorously pursuing a strike-out/dismissal of the claims against our client because the:
- The Plaintiff failed to show how Samsung caused damage to the Plaintiff’s Jetty. Under Admiralty law, our clients are likely to have no liability. A ruling is expected on this very crucial Admiralty issue.
